The USA Court of Appeal dismissed the new claim of the Winklevoss brothers against the founder of the service Facebook Mark Zuckerberg, according to the report of Agence France-Presse.
Cameron and Tyler Winklevoss filed
a lawsuit against Zuckerberg in 2004. The brothers blamed Mark for deceiving them and using their joint ideas for Facebook’s creation. The Winklevosses’ claim was based on the fact, that in 2003 Zuckerberg agreed to help them with the creation of a dating site for Harvard students. However, in February 2004 Mark launched his own version of such a resource.
The Winklevosses and Zuckerberg came to an agreement in 2008. As a compensation the brothers received a sum of 20 million dollars, as well as Facebook shares costing 45 million dollars. While counting the sum, it was assumed that the price of each share is 36 dollars. However, later on the brothers stated that they had been fed erroneous information. At the moment of the agreement the price of each share was supposedly four times lower, and that means that the compensation had not been correctly calculated.
The fact that the Winklevosses have taken legal action again, became known in December 2010. But this time the court adjudged, that the brothers do not have the right to change the terms of the agreement, reached in 2008. “This isn’t the first time that the plaintiff outstripped by the rival tries to win back in the court everything he has lost because of his failures in the market”,- is stated in judge's ruling.
